THE COURT:*
The opinion filed February 3, 1998 is hereby modified as follows:
1. On page 2, the last sentence of the first paragraph of the opinion should be deleted and replaced with the following: "We find appellant’s first and third arguments to be without merit, but we agree with appellant on the second argument. Therefore we affirm the judgment with respect to the convictions for the two counts of second degree murder and reverse it as to the two counts of gross vehicular manslaughter while intoxicated."
2. On page 12, the last sentence of the opinion, under the heading "Disposition," should read as follows: "The judgment is reversed as to appellant’s convictions for gross vehicular manslaughter while intoxicated (Pen. Code, § 191.5, subd. (a), counts 3 and 4). In all other respects, the judgment is affirmed. The trial court is directed to prepare an amended abstract of judgment."
This modification changes the judgment.
Appellant’s petition for rehearing is denied.
