MODIFICATION OF OPINION

BY THE COURT:

The opinion herein, appearing at 19 Cal.4th 353, is modified as follows:

In line 2 of the last paragraph on page 386, between "White" and "and," insert ", Aquino,". In line 3 of the same paragraph, delete the phrase ", as well as that of John Keno, a Baldwin Park police detective." So the firstence of the last paragraph on page 386 will now read as follows:

"Defendant gave his 12-minute-long taped confession at 11:40 p.m. on June 25, 1987, in the presence of White, Aquino, and Downey Police Officer Edgar Compton."

This modification does not change the judgment.
