THE COURT:*
The petition for rehearing is denied. It is ordered that the opinion filed January 3, 2001, and certified for publication on January 18, 2001, be modified as follows:
1. On page 2, the first sentence of the third paragraph is modified to read as follows: "In pertinent part, the Ordinance prohibits residents of the City from significantly impairing a view by permitting foliage to grow in excess of certain height limitations."
2. On page 6, in the first sentence of the first paragraph, the words "addresses five issues" shall be deleted and the words "makes the following contentions" shall be inserted in their place.
3. On page 6, in the third sentence of the second paragraph, the word "on" shall be inserted before the word "property."
4. On page 11, the last sentence in the first paragraph is omitted.
5. On page 12, in the first full sentence, beginning with "In support" the word "argument" shall be omitted and the word "arguments’ inserted in its place.
There is no change in judgment.
